Terms of Service

By using Terapeuta (domain logopeda.app), you agree to these Terms. If you do not agree, do not use the app.

1) Service description and audience

Terapeuta is a digital application providing a notebook / CRM and a library of professional educational materials. The app is directed to adult users: speech-language pathologists (therapists) and parents/guardians. The app is not directed to children as end users. Functionality includes:

• a library of work areas with material templates (for manual adaptation by the specialist),
• user-created plans (name, material category, stages, substages, exercises),
• manual status marking for plan elements: not started / in progress / completed,
• exercise sets (selected manually from the library),
• sharing status updates with the recipient.

Material templates are selected and configured manually by the adult user. The app does not recommend, rank, or select materials automatically.

The app does not diagnose, does not recommend therapy, does not generate clinical recommendations, and does not assess progress clinically — all decisions remain within the exclusive competence of the therapist. A diagnosis questionnaire and automated plan suggestion are not part of MVP and may be considered in a later product phase.

2) Account and authorization

• You are responsible for keeping your login credentials safe.
• Children do not create accounts on their own - a child profile is created by a parent/guardian or therapist and remains under that adult's supervision.
• A therapist using the app in their professional practice is responsible for the content they create in the app, including the lawfulness of any third-party data they may choose to record there.
• Data entered into the app must be accurate and lawfully processable.

3) Allowed use

You may not:

• use the app for illegal activity,
• upload malware or content harmful to children,
• bypass permissions, access other users' profiles, or exploit vulnerabilities,
• use the service to deceive, harass, or abuse others,
• use the app as a substitute for a professional assessment or therapy by a qualified specialist.

4) Subscriptions

The Terapeuta web service offers paid subscription plans for therapists. Subscriptions auto-renew until the user cancels; cancellation stops future renewals but does not refund the current billing period. Current pricing, billing periods, and available plans are shown only in the Terapeuta web service before purchase. The iOS/Android apps are free companion apps and do not include in-app purchases, pricing screens, upgrade calls to action, or payment links.

A parent/guardian using the app without a linked therapist does not require a subscription in MVP (scope limited to using exercise sets shared with them).

Cancellation and refunds

• The subscription is billed in advance for each period; cancellation stops future renewals. Access to subscription features continues until the end of the paid period.
• Cancellation and payment-method changes are handled in the Terapeuta web billing panel powered by Stripe Customer Portal.
• Refunds are handled by the Provider and Stripe under these Terms, the refund policy, and applicable law.
• Pricing and limits may change; notice will be provided in the Terapeuta web service and/or by email with appropriate advance notice.

5) Third-party services

Some features depend on third-party services (Supabase, Stripe, Amplitude, Firebase Cloud Messaging, Firebase Crashlytics, Apple App Store, Google Play). Their terms also apply. Apple App Store and Google Play are used to distribute the free companion apps, not to sell Terapeuta subscriptions in MVP.

6) Nature of the service and liability limits

Terapeuta is a notebook / CRM tool and a library of educational and professional materials for adult users (speech-language professionals and parents/guardians). The app organises and stores working notes, exercise programs entered manually by the specialist, status markers for program items, and assists workflow organisation (visit calendar, reminders). The app is not a medical device or clinical-use software within the meaning of the EU Medical Device Regulation (MDR 2017/745) / MDSW classification. The app does not diagnose, does not recommend materials or exercises, does not assess progress clinically, and does not optimise exercise programs; content in the app is documentation of decisions made manually by the specialist. The app does not replace a visit to a speech-language professional, does not constitute a clinical assessment, and is not intended for self-treatment.

To the extent allowed by law, the service is provided "as is" and "as available". We are not liable for indirect losses, third-party-service downtime, or data inaccuracies caused by faulty external integrations. We are not liable for the clinical effects of decisions taken by a specialist or parent/guardian based on data recorded in the app — such a decision remains within the exclusive competence of a qualified professional.

7) Account deletion

You can delete your account in the app: Settings → Irreversible zone → Delete account. You can also request account deletion by sending a message to the contact email. Full procedure: Account deletion page. In-app deletion is performed after successful confirmation with an email code; an email request starts a process of deleting the account and associated data within 30 days, subject to mandatory retention periods required by law.

8) No AI / generative models

The Terapeuta app does not use artificial intelligence or generative models. Content in the app is entered directly by the therapist or parent. We do not send user data to external AI models. If AI-assisted features are added in the future, their scope will be limited to text editing or material search in the library; AI will not select therapy, generate recommendations, or assess progress clinically. Adding any AI feature requires an update to these Terms and a separate user consent.

9) Changes and termination

• We may update these Terms, remove features, or discontinue part of the service. If you do not accept changes, stop using the app.
• Accounts can be suspended or terminated for serious misuse or repeated security violations.

Additional Legal Terms

11) Limited license and app stores

• We grant you a limited, non-exclusive, non-transferable, revocable license to use Terapeuta only for the lawful purpose of supporting speech therapy.
• If you downloaded the app via Apple App Store or Google Play, those platforms' terms also apply to downloading and using the free companion app. Terapeuta subscription billing is handled in the web service through Stripe, not through the app stores.

12) Responsibility for content entered into the app

• The app does not require entering data identifying a child (name, contact details, medical history). The user creates exercise sets, session templates, and their own working notes; for internal identification, pseudonyms or anonymous identifiers are recommended.
• If the user (therapist or parent/guardian), contrary to the instruction, enters into their content personal data of third parties (e.g., patients, children), the user is the data controller of that data within the meaning of GDPR and is responsible for having a lawful basis, obtaining required consents, and handling data-subject rights requests.
• The Provider acts as a processor of the user's content on the user's documented instructions (acceptance of these Terms and the user's choice of in-app features). Detailed allocation of roles and obligations under Art. 28 GDPR is described in the Privacy Policy, section 8 "Data processing terms".
• Data-subject rights requests (access, rectification, erasure, restriction, objection, portability) are handled upon a written submission sent to the contact email.

13) Intellectual property and feedback

• The app, software, and trademarks are owned by the Provider or its licensors.
• Educational and professional materials made available in the app (e.g., exercise-set templates, supporting materials for manual adaptation by the specialist) are protected by copyright. The app provides a library of materials selected manually by the adult user; it does not generate clinical or therapeutic content.
• Feedback you provide may be used by the Provider without compensation to improve the service.

14) Warranty disclaimer

To the maximum extent allowed by law, the service is provided "as is" and "as available" without warranties of uninterrupted operation, fitness for a specific purpose, or error-free performance. We do not warrant therapeutic outcomes, which are determined by a qualified specialist.

15) Indemnity

You agree to defend and indemnify the Provider from third-party claims, losses, and expenses arising from your unlawful use of the service, your violation of these Terms, or your violation of others' rights (including the rights of the child).

16) Governing law and disputes

• Unless mandatory local consumer law requires otherwise, these Terms are governed by Polish law, and disputes are resolved by courts having jurisdiction over the Provider's place of establishment.
• Before formal legal action, both sides agree to try to resolve disputes in good faith via jetware.software@gmail.com.

17) Translation and priority

Local-language versions are provided for convenience. To the extent allowed by law, for users in Poland the Polish version controls; for users outside Poland, in case of inconsistency the English version controls.
