Terms of Service

By using Terapeuta (domain logopeda.app), you agree to these Terms. If you do not agree, do not use the app.

1) Service description

Terapeuta is a digital application supporting speech therapy for children. The app provides tools for three roles: therapist (speech-language pathologist), parent/guardian, and child patient. Functionality covers therapy plans, diagnosis records, exercise generation and tracking, progress reporting, notifications and reminders.

2) Account and authorization

• You are responsible for keeping your login credentials safe.
• Children do not create accounts on their own - a child profile is created by a parent/guardian or therapist and remains under that adult's supervision.
• A therapist using the app in their professional practice manages only patient profiles that belong to them and for which valid parental consent has been obtained.
• Data entered into the app must be accurate and lawfully processable.

3) Allowed use

You may not:

• use the app for illegal activity,
• upload malware or content harmful to children,
• bypass permissions, access other users' profiles, or exploit vulnerabilities,
• use the service to deceive, harass, or abuse others,
• use the app as a substitute for a professional diagnosis or therapy by a qualified specialist.

4) Subscriptions

• Features are provided according to the active plan (for example, patient-count limits for therapists, access to therapeutic content).
• Subscription billing is handled by the platform store (Apple App Store or Google Play) under that platform's terms.
• Pricing and limits may change; notice will be provided in release notes and/or in-app with advance warning.

5) Third-party services

Some features depend on third-party services (Supabase, Amplitude, Firebase Cloud Messaging, Firebase Crashlytics, RevenueCat, Apple App Store, Google Play). Their terms also apply.

6) Limitation of liability and nature of the service

Terapeuta organizes and stores therapeutic data and supports therapy delivery, but it does not replace a visit to a speech-language pathologist, does not constitute a medical diagnosis, and is not intended for self-treatment. The app is not a medical device.

To the extent allowed by law, the service is provided "as is" and "as available". We are not liable for indirect losses, third-party-service downtime, or data inaccuracies caused by faulty external integrations. We are not liable for the clinical effects of therapeutic decisions taken by a therapist or parent based on data in the app - such a decision remains within the exclusive competence of a qualified professional.

7) Changes and termination

• We may update these Terms, remove features, or discontinue part of the service. If you do not accept changes, stop using the app.
• Accounts can be suspended or terminated for serious misuse or repeated security violations.

Additional Legal Terms

9) Limited license and app stores

• We grant you a limited, non-exclusive, non-transferable, revocable license to use Terapeuta only for the lawful purpose of supporting speech therapy.
• If you downloaded the app via Apple App Store or Google Play, those platforms' terms also apply. Billing, cancellation, and refunds are handled by the platform you purchased through.

10) Responsibility for personal data entered into the app

• A therapist using the app in professional practice is responsible for having a lawful basis to process patient data in the app (in particular, parental/guardian consent) and for compliance with GDPR and professional regulations.
• A parent/guardian is responsible for the accuracy of the child data entered and for having proper authority to represent the child.
• Unless separately agreed in writing, the user (therapist or parent) is the data controller of patient data they enter into the app within the meaning of GDPR, and Terapeuta acts as a data processor on their instructions.

11) Intellectual property and feedback

• The app, software, and trademarks are owned by the Provider or its licensors.
• Therapeutic content provided by the app (e.g., exercise sets, speech-therapy materials) is protected by copyright.
• Feedback you provide may be used by us without compensation to improve the service.

12) Warranty disclaimer

To the maximum extent allowed by law, the service is provided "as is" and "as available" without warranties of uninterrupted operation, fitness for a specific purpose, or error-free performance. We do not warrant therapeutic outcomes, which are determined by a qualified specialist.

13) Indemnity

You agree to defend and indemnify the Provider from third-party claims, losses, and expenses arising from your unlawful use of the service, your violation of these Terms, or your violation of others' rights (including the rights of the child).

14) Governing law and disputes

• Unless mandatory local consumer law requires otherwise, these Terms are governed by the law of Poland, and disputes are resolved by courts having jurisdiction over the Provider's place of establishment.
• Before formal legal action, both sides agree to try to resolve disputes in good faith via jetware.software@gmail.com.

15) Translation and priority

Local-language versions are provided for convenience. To the extent allowed by law, for users in Poland the Polish version controls; for users outside Poland, in case of inconsistency the English version controls.
